FAP Change request form cover

What sort of publication it is: Form
Who it's for: Homeowners
Purpose: The Change Request Form is used by the Homeowner if they wish to exceed and/or increase the contingency amount for Approved Repairs.

Contractor statement form

Contractor statement form cover

What sort of publication it is: Form
Who it's for: Homeowner to obtain, signed, from their builder.
Purpose: This form ensures that the builder agrees to certain terms, including site access for the Ministry and the council during construction. The completed form is submitted with the payment plan application.

Designer statement form

Designer statement form cover

What sort of publication it is: Form
Who it is for: Designers.
Purpose: This statement is to be signed by the Designer to say that the repair plans will fix all leaky issues identified in the assessor's report and also the degree of betterment incorporated in the design.

Discontinuance addendum

Discontinuance addendum cover

What sort of publication it is: Form
Who it's for: Homeowners and Body Corporates in a multi-unit complex that wish to enter FAP and are currently in proceedings.
Purpose: When homeowners in a multi-unit complex enter into a Homeowner Agreement, the unit owners, and the body corporate, need to obtain a stay in their proceedings, and once all other contribution criteria are met the proceedings must be discontinued in order to receive contribution payments. We recommend this is discussed with your legal advisor.

Who it's for: Homeowners.
Purpose: The Final payment claim and statements is used by the Homeowner to submit their final FAP payment claim to the Ministry.

Who it's for: Bodies corporate or their representatives.
Purpose: The multi-unit funding summary summarises the individual loans or funding for each unit in the complex that make up the claimant contributions towards repair costs.

Notice to proceed form

Notice to proceed form cover

What sort of publication it is: Form
Who it's for: Homeowners.
Purpose: For Homeowners to confirm that they are proceeding with repairs in accordance with their homeowner agreement. When provided to the Ministry the homeowner agreement becomes unconditional.

Purpose: The Payment Claim Form is used by the Homeowner to submit their FAP payment claim to the Ministry.

Payment plan application form

Payment plan application form cover

What sort of publication it is: Editable spreadsheet
Who it is for: Homeowners and/or Designers
Purpose: To submit their payment plan to obtain approval from the Ministry. It summarises the total remediation costs and sets out the payment milestones. It also captures any betterment-related work being undertaken at the same time.  As of March 2013, this form now incorporates the quote template and the payment plan calculator.

Proof of affordability form

Proof of affordability form

What sort of publication it is: Form
Who it is for: Homeowners.
Purpose: This form is for the homeowner to complete and include with sufficient evidence of funding (ie. Bank loan pre-approval printed on original bank letterhead, Signed Additional Contributing Party Addendum or Original bank statement) to the Ministry. This confirms to the Ministry that the claimant is able to access the necessary funds to pay for their share of the repair costs.

Repair plan approval application form

What sort of publication it is: Form
Who it's for: For homeowners who have a homeowner agreement in place and wish to submit their Repair Plan to the Ministry for approval.
Purpose: This form seeks to confirm that appropriate documentation is supplied and any betterment is clearly differentiated.

Review of Affordability form

Review of Affordability form cover

What sort of publication it is: Form
Who it's for: Homeowners
Purpose: This form is for the homeowner to complete once actual quoted repair costs have been obtained. It is submitted together with evidence of sufficient funding (i.e. bank loan pre-approval printed on original bank letterhead, proof of third party contribution, proof of cash contribution and availability). This confirms that the claimant is able to access the necessary funds to pay for their share of the actual repair costs.

Sample addendum for additional contributor

Sample addendum for additional contributor cover

What sort of publication it is: Form
Who it's for: The homeowner, the Government and the additional contributing party .
Purpose: When signed, this form is incorporated into the standard homeowner agreement. It amends the terms of the Standard Homeowner Agreement so that it includes details of the additional contributor and their contribution towards repair costs by way of cash or goods or services. This version of the addendum is used when the Council (Territorial Authority) is contributing to the financial assistance package for the claim.

Sample Homeowner Agreement

What sort of publication it is: Form
Who it's for: The standard agreement for the homeowner, the Council (TA) and the Government.
Purpose: This sets out the obligations of the homeowner to receive financial contribution from the Ministry and Council. Also contains information once they start repairs and includes:

  • the steps they need to follow to prepare and agree a Repair Plan and Payment Plan
  • the obligation to provide a Notice to Proceed and the consequence of providing a Notice to Proceed 
  • the obligation to make information available
  • the consequences of defaulting which may include having to repay contributions.

It explains that the homeowner's legal rights are altered once they receive the first payment so that they can no longer sue contributing parties.

Purpose: When signed, this form is incorporated into the standard homeowner agreement. It amends the terms of the Standard Homeowner Agreement so that it is suitable for multi-unit complexes and stand-alone complexes. This version of the addendum is used when the TA is participating.

Statutory Declaration 9

What sort of publication it is: Form
Who it's for: Bodies corporate or their representatives.
Purpose: To be signed by the Body Corporate or representative advising they have authority from all of the owners of units within the complex to enter into a Homeowner Agreement, and to authorise carrying out repairs on each of the units of the complex.
